HUNGRY DELIVERY TERMS AND CONDITIONS

Please read the below terms carefully. By using or submitting an order (and any subsequent orders) on this web site you are agreeing to the terms that appear below.

To register with and shop with hungrydelivery.co.uk you must be eighteen years of age or over.

These terms and conditions do not affect your statutory rights.

1. Using Hungry Delivery Ltd

This website is operated by Hungry Delivery Ltd and by using hungrydelivery.co.uk you (the customer) is bound by these terms and conditions. The Hungry Delivery website is provided to you free of charge for your personal use subject to these Terms and Conditions.

All orders and purchases made on the hungrydelivery.co.uk website will also be governed by the Terms and Conditions of the specific shop(s) you are purchasing from.

We reserve the right to revise these Terms and Conditions. Please check for changes each time you order from hungrydelivery.co.uk. These Terms and Conditions were updated on 09th September 2010 and apply to sales to consumers.

2. Purchasing From Hungry Delivery Ltd

Hungry Delivery Ltd will confirm acceptance of the your order when placed using hungrydelivery.co.uk, by email to the email address you have provided us. After you have confirmed the order and completed the payment details, you are bound within these terms and conditions.

Your account with Hungry Delivery Ltd is not a credit account, so payment will be required upon the confirmation of your order.

Acceptance of an order takes place on payment of the order, which is when the purchase contract(s) will be made between you and the relevant shops(s) and you will be charged for your order. You will receive confirmation by email that your order is being delivered.

The law places restrictions on transactions involving alcohol, and therefore alcohol must be either ordered by you or delivered by us during normal licensing hours. If you have ordered alcohol from us and cannot be at home at your selected delivery time, it is your responsibility to ensure that a suitable person is there to receive the order.


3. Prices

The price of the produce on hungrydelivery.co.uk will be the price you confirm when paying through the PayPal system.

Where items are sold by weight, there is often a small weight range (expressed per kilogram or other appropriate unit of measurement). The price of these items will be the price related to the middle of this price range ie if the price range is 290g-310g, the price will relate to 300g.

The prices stated on the website are inclusive of any VAT payable.

4. Methods of Payment

We accept payment by Mastercard, Visa, Maestro, Delta and Switch . We do not accept payments by cash or cheque.

Your credit card and payment details will be held by PayPal, our trusted and secure payment provider. We will not keep a record of your card details on this site .

5. Delivery

Delivery dates and times will be as specified on the delivery time slot page on the website and will be made to the address stated by you when setting up your account with hungry delivery. If your address changes you must notify us before confirming an order. You can do this on the My Account section of the website.

We reserve the right not to deliver to certain areas and eliminate certain areas from our delivery plan.

Hungry Delivery will endeavour that deliveries are made within the time slot requested. It is your responsibility to ensure that an appropriate person is available at the delivery address during the delivery slot. We request that an appropriate person signs for the goods on delivery.

Events outside of our reasonable control, such as adverse weather conditions may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to in order to reschedule your delivery time and date. We aim to do this within 24 hrs of the original delivery time - if this suits the customer. In any event, our liability to you will be limited to the price of goods not delivered and the cost of delivery.

You will not be charged for incorrect products or products which we have not delivered in accordance with these Terms and Conditions. Otherwise our liability is limited to the price of the incorrect products or the products not so delivered.

Should you fail to be present for your delivery we are entitled to charge you in full for an amount equal to the price of perishable items contained in your order and the cost of delivery.

We will always try to supply you with the full quantity that you have ordered. In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us immediately. You will not be charged for any incorrect goods or goods which you have not received.

 

We will usually only make deliveries when an appropriate person is able to receive the delivery. In the unusal event that you instruct Hungry Delivery to leave a delivery unattended at your address we dismiss all liability which may arise by leaving the delivery unattended. This includes but is not limited to theft, tampering, contamination and the result of any change in temperature in respect of items which need to be kept chilled or frozen.

6 Delivered Goods

If any delivered goods are in your opinon defected in any way, you must notify us immediately in writing, by phoning or emailing hungry delivery. Or by using the online refund service on the website of any dissatisfaction with your order. We will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction or arrange for the delivery of replacement goods, provided that you notify us within 7 days of delivery of the goods.

7 Warranty and Liability

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen's Advice Bureau.

We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

Our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.

8 Privacy

We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise.

At the time of your registration you will receive a password. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with your password. You must immediately notify us of any unauthorised use of your e-mail address and/or password or any breach of security known to you.

9 General

If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use the material data and content only for your personal use in placing orders through hungrydelivery.co.uk, and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the hungrydelivery.co.uk website without hungrydelivery.co.uk's prior written permission. Hungry Delivery may impose a fee on any proposed use of the material data and content contained on its website, other than for placing orders through the hungry delivery website.

These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.

We have close working relationships with the independent shops whose products we makes available for sale on our website. However, the companies do not have any liability for each other's obligations nor are they jointly or severally liable for any legal purposes.
